Wednesday, June 18, 1986 B7 Austin American-Statesman Lawyer uses cattle prod in Kerrville slave trial were FIRST IN PERSONAL SERVICE because WE then do things your way. .1 KERRVILLE (AP) A defense attorney stood before a Jury and shocked himself with the same cat-tie prod prosecutors claim was used to torture a drifter on a Hill Country ranch and later used to kill him. Attorney Dan Cogdell activated the shocking device on his left forearm in court Tuesday after a Rice University professor testified that the prod's electrical current cannot seriously hurt anyone. Three men are on trial on organized crime charges in an alleged conspiracy to commit aggravated kidnapping and murder in the March 1984 death of Anthony Bates one of several drifters prosecu tors say were lured to the ranch with the promise of work and then tortured and forced to stay. Prosecutors allege Bates was fatally tortured with the prod, after which his body was burned.

Earlier testimony Indicated Bates was held under water in a natural spring during the torture sessions. But in the second day of defense testimony In the six-week-old trial, defense witness Arthur Few, an at- mospheric electricity expert, said FBI special agent Charles Wilmore failed to properly perform his studies on the cattle prod. Wilmore, who earlier testified for the prosecution, misrepresented the cattle prod's potential to injure someone, Few said. Richard "Racehorse" Haynes who is representing defendants Walter Wesley Ellebracht 55; his son, Walter Wesley Ellebracht 33; and former ranch hand Carlton Robert Caldwell, 21 told Cogdell, his associate, to demonstrate the cattle prod on himself for the Jury. The 29-year-old Cogdell first held the prod's probes to his forearm, still covered by his suit and shirt.

He showed no reaction to the buzzing device except a slight twitch of his hand. "Use fresh batteries. Do it on the skin," said prosecutor Gerald Carruth. Cogdell took off his suit coat, and Haynes held the prod. "I'm going to shock him where he spends the most time on his rear end," Haynes said, bringing laughter from the jury.

The prod has a maxium rms current of two milliamps, Few testified. About 100 milliamps are needed to cause irregular heartbeats, he said. Prosecutors maintain Bates was shocked on the genitals and tongue, and eventually died from the abuse. Deaths and funerals Reverend Logan Cummlngs officiating. Arrangements entrusted to Forest Oaks Funeral Home, 6701 Convict Hill Road, Oak Hill.
